9/19/24 OPEN MEMO TO VIRGINIA LEGISLATURE
RE: Duty to Rectify Wrongful Official Act(s) - Virginia Grand Juries not in compliance with RULE OF LAW
Great Day and Thank You for Your Elected Service to our Communities!
Virginia Code Chapter 13 (§ 19.2-191 through § 19.2-216) conflicts with Amendment V of our Constitution as affirmed in the U. S. Supreme Court 1992 Williams ruling. Here are some relevant details;
1. Page 47, “...the grand jury is an institution separate from the courts,over whose functioning the courts do not preside…”
2. Page 48, “...the grand jury ‘can investigate merely on the suspicion that the law is being violated, or even because it wants assurance that it is not’…”
3. Page 68, “...the grand jury is not merely an investigatory body, it also serves as a “protector of citizens against arbitrary and oppressive governmental action.”
Community efforts to have our court rectify this problem have been met with unlawful behaviors including excessive force, false arrests and jailings. Related filings are docketed at the 4th Circuit Court of Appeals.
Please advise what remedy our Elected Legislature will provide to immediately restore RULE OF LAW non-government citizen grand jury oversight.
